Mutual wills
Mutual wills are wills made by two or more persons, usually in similar terms and leaving their estates to each other. The wills are made following an agreement between them to make such wills and not to revoke them without the consent of the other(s). Upon the death of one or more of the parties to the agreement, the remaining parties cannot alter their wills as they are then unable to obtain the consent of the other party(s) to the agreement. It is not enough for there to be a common intention, expectation or desire that the wills should not be revoked. There must effectively be a contract between the parties that the wills are irrevocable and will remain unaltered.

Restrictive Covenants
If you want to enforce a restrictive covenant not to use land in a particular way, you must identify the land that would benefit from the restrictive covenant and the restrictive covenant must pass to you by annexation, assignment or building scheme.
